PLEASE READ THESE TERMS CAREFULLY. By accessing or using FixaPros.com you agree to be legally bound by these Terms of Service. If you do not agree, you must immediately discontinue use of the platform.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Homeowner," or "Pro") and FixaPros LLC ("Company," "we," "us," or "our"), the operator of FixaPros.com ("Platform"). By registering, accessing, or using any portion of the Platform, you expressly agree to these Terms, our Privacy Policy (incorporated herein by reference), and all applicable federal, state, and local laws and regulations, including all applicable tax laws in all 50 United States.
These Terms apply to all users of the Platform, including homeowners seeking services ("Homeowners") and contractors, service professionals, or businesses listing services on the Platform ("Pros" or "Contractors").
FixaPros LLC operates an online marketplace that connects Homeowners with independent Pros for home improvement, repair, and maintenance services. FixaPros LLC is a technology platform and lead generation service only. FixaPros LLC is NOT a contractor, does NOT perform any home services, and does NOT employ any Pros. All Pros are independent contractors solely responsible for the quality, safety, licensing, insurance, and legality of their work.
We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time without notice or liability to you.
You must be at least 18 years of age and legally capable of entering into binding contracts under applicable law to use this Platform. By using the Platform, you represent and warrant that you meet these requirements. Use of the Platform by anyone under 18 is strictly prohibited.
You are responsible for maintaining the confidentiality of your account information. You agree to provide accurate, complete, and current information. You are solely responsible for all activity that occurs under your account. FixaPros LLC reserves the right to suspend or terminate any account at its sole discretion, including for violation of these Terms, provision of false information, fraudulent activity, or any conduct deemed harmful to the Platform or its users.
All Pros using this Platform agree and acknowledge that:
Pros may claim homeowner requests at the price displayed before claiming: $15, $25, $45, or $75, based on service category and the homeowner’s selected project budget. An optional prepaid credit can also be used for one claim. For the first 15 minutes, up to three matched Pros total may view a request; if it remains unclaimed, availability expands over time. A successful claim unlocks the homeowner’s contact details and makes the request unavailable as unclaimed to other Pros. FixaPros LLC does not guarantee a homeowner response, appointment, accepted quote, completed work, or payment.
A Pro may report a claimed request once through the contractor dashboard within 72 hours of the request’s creation. Submitting an in-app report returns one lead credit, not cash. Requests for cash refunds are handled separately under the Refund & Dispute Policy. All payments are processed through third-party payment processors. FixaPros LLC does not store payment card information.

Homeowners agree to provide accurate information about their service requests. Homeowners acknowledge that FixaPros LLC does not guarantee the quality or completion of any services performed by Pros. Homeowners are solely responsible for verifying a Pro's credentials, licensing, and insurance before engaging their services. FixaPros LLC strongly recommends obtaining multiple quotes and verifying references before hiring any Pro.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. FIXAPROS LLC DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
FixaPros LLC makes no warranty or representation regarding the quality, safety, suitability, accuracy, completeness, or reliability of any Pro or their services. Your use of the Platform and any services obtained through it are entirely at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIXAPROS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FIXAPROS LLC'S TOTAL CUMULATIVE LIABILITY TO ANY USER FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO FIXAPROS LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless FixaPros LLC, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any dispute between you and another user; or (e) any services provided or obtained through the Platform.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising from or relating to these Terms or the Platform ("Dispute") shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except for claims that qualify for small claims court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Arbitration shall be conducted in the county of your residence, or at your election, by telephone or videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
These Terms and any Dispute shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles, except where pre-empted by federal law.
Information We Collect: We collect information you provide directly (name, email, phone, address, payment info, service details), information generated by your use of the Platform (IP address, browser type, pages visited, search queries), and information from third-party services.
How We Use Your Information: We use your information to operate the Platform, match Homeowners with Pros, process payments, send service-related communications, improve our services, comply with legal obligations, and enforce these Terms.
Information Sharing: We share your contact information with matched Pros or Homeowners as necessary to facilitate connections. We do NOT sell your personal information to third parties for marketing purposes. We may share information with service providers, payment processors, and law enforcement as required by law.
Data Retention: We retain your data for as long as your account is active and for 90 days following account deletion, then permanently delete it except where retention is required by law.
Your Rights: Depending on your state, you may have the right to access, correct, delete, or export your personal data. Submit requests to info@fixapros.com.
California Residents (CCPA): California residents have additional rights under the California Consumer Privacy Act, including the right to know what personal information is collected, the right to delete personal information, and the right to opt out of the sale of personal information. FixaPros LLC does not sell personal information.
Security: We implement industry-standard technical and organizational measures to protect your information. However, no method of internet transmission is 100% secure and we cannot guarantee absolute security.
All content on the Platform, including text, graphics, logos, images, and software, is the exclusive property of FixaPros LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written consent.
FixaPros LLC reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Effective Date" at the top of this page and, where appropriate, via email. Your continued use of the Platform following any modification constitutes your acceptance of the modified Terms.
FixaPros LLC reserves the right to suspend or terminate your access to the Platform at any time, for any reason, including violation of these Terms, with or without notice. You may terminate your account at any time by contacting us or using the account management features. Upon termination, all licenses granted to you under these Terms shall immediately cease.
These Terms constitute the entire agreement between you and FixaPros LLC with respect to the Platform and supersede all prior agreements. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
